1. Purpose

These Terms of Use define the terms and conditions of use of the HelloServ website and the hosting services offered.

2. Acceptance of terms

The use of the site and services implies full and complete acceptance of these terms of use and terms of sale.

By creating an account on HelloServ, you declare that you have read, understood and accepted without reservation all of these Terms of Use (ToU) and Terms of Sale (ToS).

If you do not accept these terms, you must not create an account or use our services.

3. Services offered

HelloServ provides game server and Cloud VPS hosting services, including:

• Game server hosting (FiveM, Minecraft, Rust, etc.)
• Cloud VPS and dedicated servers
• Anti-DDoS protection
• 24/7 technical support
• Control panel

4. Service availability

Our platform is accessible via the Internet worldwide. We strive to ensure optimal availability of our services, but cannot guarantee uninterrupted operation. Maintenance operations may require temporary service interruptions.

5. Anti-DDoS Protection

HelloServ offers Anti-DDoS protection on all its services. This protection is provided by an external provider specializing in DDoS attack prevention and protection with over 10 years of experience. It aims to mitigate denial of service attacks but cannot guarantee absolute protection against all forms of attacks. In case of a massive DDoS attack, we reserve the right to temporarily suspend the affected service.

6. Prohibited content

The following are strictly prohibited on our entire infrastructure:

• Content of a pedopornographic, racist, hateful or discriminatory nature
• Content promoting terrorism or inciting violence
• Content violating intellectual property rights
• Malicious software, viruses or any malicious programs
• Hosting of phishing or scam services
• Unauthorized cryptocurrency mining
• Content violating applicable French law

In general, any content or use deemed illegal by HelloServ will be prohibited. This list is not exhaustive and may be supplemented at any time by HelloServ.

HelloServ reserves the right to prohibit any content or use deemed illegal at any time, without prior notice or justification.

7. Fair use of resources

For shared offers not marked as "unlimited", the client agrees to make reasonable use of resources. Extreme and disproportionate usage affecting the experience of other users on the same node may result in limitations or suspension of service. For intensive needs, we recommend our offers with 100% dedicated resources.

8. Service suspension in case of abuse

HelloServ reserves the right to block the client's user account, or access to their service, if their usage behavior or the behavior of users of the client's service harms the operation of the infrastructure in any way. HelloServ will inform the client of the necessary blocking, to the extent possible according to the company's resources and concrete circumstances, beforehand or as soon as it takes effect.

As a reminder, according to Article 323-2 of the French Penal Code: "The act of hindering or distorting the operation of an automated data processing system is punishable by five years' imprisonment and a fine of 75,000 euros".

9. Responsibilities

HelloServ is committed to providing quality service but cannot guarantee 100% availability. The user is responsible for the content they host and their use of the services.

10. Intellectual property

All elements of the HelloServ site and its services (texts, logos, images, source code, database, etc.) are protected by copyright and remain the exclusive property of FLEXICORE SAS. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements without the prior written authorization of FLEXICORE SAS is strictly prohibited.

11. Force majeure

HelloServ's liability cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these general conditions results from a case of force majeure. Are considered as cases of force majeure: natural disasters, wars, riots, fires, floods, explosions, strikes, lockouts, interruptions of telecommunications networks or difficulties specific to external telecommunications networks.

12. Modification of Terms

HelloServ reserves the right to modify these Terms at any time. Users will be notified of changes by email or via the website.

1. Acceptance of ToS

Any order of services on HelloServ implies unconditional acceptance of these Terms of Sale (ToS).

By validating your order and making payment, you acknowledge having read and accepted all of these terms.

2. Products and services

HelloServ sells game server and Cloud VPS hosting services. Detailed characteristics of each offer are available on the website.

3. Order and activation

The order is validated after receipt of payment. Service activation generally occurs within 60 seconds after order validation.

However, some orders may be subject to manual verification, which may extend the activation time. For any questions regarding the status of your order, our support team remains available.

4. Availability of dedicated servers

For dedicated servers, the stock status displayed on our site may not accurately reflect the actual availability of equipment in our datacenter. Delivery time may extend up to 7 business days. Beyond this period, if we cannot fulfill the order, an automatic refund will be made.

5. Configuration variations

HelloServ reserves the right to make slight but equivalent variations to the hardware configurations presented on the site, depending on component availability. The client will be informed of any significant changes before service delivery. These variations will not affect the overall performance of the ordered service.

6. Bandwidth and network performance

The speeds indicated for our services represent the theoretical maximum capacity of the network connection. These values are provided on a "best effort" basis and may vary depending on many factors: shared use of network equipment, specific server configuration, overall network load, etc.

7. Backups and data

HelloServ is not responsible for backups or data loss on client services, unless a specific backup contract has been concluded. The client is strongly encouraged to implement their own regular data backup solutions.

8. Pricing and payment terms

Prices are expressed in euros including the standard French VAT rate of 20% (EU VAT number FR02 989 715 958). Payment can be made by credit card, PayPal or bank transfer. Invoices are automatically issued and available in the customer area. Business customers subject to VAT in another EU member state may benefit from VAT-exempt invoicing upon providing a valid EU VAT number.

9. Duration, renewal and termination

Services are subscribed for a fixed period (monthly, quarterly, annual).

Automatic renewal: By default, automatic renewal is enabled on all services. To avoid any service interruption, payment is processed 5 days before the expiration date. If your account balance is sufficient to cover the full invoice, it will be used as a priority. Otherwise, your registered payment method will be charged. You need to disable automatic renewal at least 5 days before the expiration date via your customer area. Once the renewal is completed and payment is collected, no refund will be granted.

Termination: To avoid any charge, you must disable automatic renewal at least 5 days before your service expiration date. Once automatic renewal is disabled, your service will remain active until the end of the paid period, then will be suspended. No refund will be made for already paid periods.

Permanent deletion: Any service suspended for non-payment will be permanently deleted, along with all associated data (files, databases, backups), after 48 hours of suspension. This deletion is irreversible and no data recovery will be possible.

10. Termination by HelloServ

HelloServ reserves the right to terminate any contract without notice or compensation in the following cases: non-compliance with the Terms of Use or Terms of Sale, abusive use of resources, hosting of illegal content, non-payment, or any action likely to harm the infrastructure or other clients. The client will be informed of the termination by email. In this case, no refund will be made.

Any chargeback or payment dispute filed with a bank or payment platform will result in the immediate and automatic suspension of all the client's services, pending resolution. HelloServ reserves the right to contest any abusive chargeback and to claim the associated fees.

11. Final Sales

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period.

As all our services (game servers, VPS, dedicated servers) are deployed and activated immediately after order validation, all sales are definitively final and no refund will be made, regardless of the reason. By validating your order, you expressly agree that the service begins immediately and waive your right of withdrawal.

This policy applies without exception to promotions, special offers, personalized services and renewals. No refund request, whether partial or total, will be granted.

In the case of a multi-monthly or annual subscription, the entire paid period is considered a final sale. No partial or pro-rata refund will be made, regardless of the cancellation date.

12. Dedicated Server Sales Policy

All dedicated server sales are final once the order is confirmed and payment has been made. No refund will be granted.

Single exception: if we cannot deliver the server within 7 business days despite the availability displayed at the time of order, an automatic and full refund will be made.

13. Fair use of "unlimited" resources

For offers mentioning "unlimited" resources, a fair use policy applies. If usage significantly exceeds that of standard usage, to the point of compromising the stability or performance of the shared infrastructure, HelloServ reserves the right to limit allocated resources after notifying the client.

14. Technical support

Standard technical support is available Monday to Friday during business hours, with occasional presence during weekends. To benefit from guaranteed 24/7 support with priority handling of requests, the Support+ option is available for an additional fee.

15. Personal data processing

Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR). HelloServ commits to collecting only data strictly necessary for contract execution and to protecting it against unauthorized access. The client has the right to access, rectify, oppose, limit, port and erase their personal data. For more details, consult our Privacy Policy.

16. Applicable law

These Terms of Sale are subject to French law. In case of dispute, after failure of an amicable solution, French courts will have exclusive jurisdiction.

Data collection

HelloServ collects the following data:

• Identification data (name, first name, email)
• Billing data
• Technical data (IP address, connection logs)
• Service usage data

Data usage

The collected data is used for:

• Providing the ordered services
• Customer support
• Billing
• Service improvement
• Security and fraud prevention

Data retention

Data is kept for the duration of the contractual relationship, then archived for 5 years for legal and accounting reasons.

User rights

In accordance with GDPR, you have the following rights:
