1. Acceptance of ToS
Any order of services on HelloServ implies unconditional acceptance of these Terms of Sale (ToS).
By validating your order and making payment, you acknowledge having read and accepted all of these terms.
2. Products and services
HelloServ sells game server and Cloud VPS hosting services. Detailed characteristics of each offer are available on the website.
3. Order and activation
The order is validated after receipt of payment. Service activation generally occurs within 60 seconds after order validation, unless otherwise stated or in specific cases detailed below.
4. Availability of dedicated servers
For dedicated servers, the stock status displayed on our site may not accurately reflect the actual availability of equipment in our datacenter. Delivery time may extend up to 7 business days. Beyond this period, if we cannot fulfill the order, an automatic refund will be made.
5. Configuration variations
HelloServ reserves the right to make slight but equivalent variations to the hardware configurations presented on the site, depending on component availability. The client will be informed of any significant changes before service delivery. These variations will not affect the overall performance of the ordered service.
6. Bandwidth and network performance
The speeds indicated for our services represent the theoretical maximum capacity of the network connection. These values are provided on a "best effort" basis and may vary depending on many factors: shared use of network equipment, specific server configuration, overall network load, etc.
7. Backups and data
HelloServ is not responsible for backups or data loss on client services, unless a specific backup contract has been concluded. The client is strongly encouraged to implement their own regular data backup solutions.
8. Pricing and payment terms
Prices are expressed in euros including VAT. Payment can be made by credit card, PayPal or bank transfer. Invoices are automatically issued and available in the customer area.
9. Duration, renewal and termination
Services are subscribed for a fixed period (monthly, quarterly, annual).
Automatic renewal: By default, automatic renewal is enabled on all services. At the expiration of the current period, your service will be automatically renewed. If your account balance is sufficient to cover the full invoice, it will be used as a priority. Otherwise, your registered payment method will be charged. You need to disable automatic renewal at least 24 hours before the expiration date via your customer area. Once the renewal is completed and payment is collected, no refund will be granted.
Termination: To avoid any charge, you must disable automatic renewal at least 24 hours before your service expiration. Once automatic renewal is disabled, your service will remain active until the end of the paid period, then will be suspended. No refund will be made for already paid periods.
Permanent deletion: Any service suspended for non-payment will be permanently deleted, along with all associated data (files, databases, backups), after 48 hours of suspension. This deletion is irreversible and no data recovery will be possible.
10. Termination by HelloServ
HelloServ reserves the right to terminate any contract without notice or compensation in the following cases: non-compliance with the Terms of Use or Terms of Sale, abusive use of resources, hosting of illegal content, non-payment, or any action likely to harm the infrastructure or other clients. The client will be informed of the termination by email. In this case, no refund will be made.
11. Final Sales
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period.
As our game servers are deployed and activated immediately after order validation, all sales are final and no refund will be granted. By validating your order, you expressly agree that the service begins immediately and waive your right of withdrawal.
This provision also applies to promotions, personalized services and renewals.
12. Dedicated Server Sales Policy
All dedicated server sales are final once the order is confirmed and payment has been made. No refund will be granted.
Single exception: if we cannot deliver the server within 7 business days despite the availability displayed at the time of order, an automatic and full refund will be made.
13. Fair use of "unlimited" resources
For offers mentioning "unlimited" resources, a fair use policy applies. If usage significantly exceeds that of standard usage, to the point of compromising the stability or performance of the shared infrastructure, HelloServ reserves the right to limit allocated resources after notifying the client.
14. Technical support
Standard technical support is available Monday to Friday during business hours, with occasional presence during weekends. To benefit from guaranteed 24/7 support with priority handling of requests, the Support+ option is available for an additional fee.
15. Personal data processing
Personal data collected is processed in accordance with the General Data Protection Regulation (GDPR). HelloServ commits to collecting only data strictly necessary for contract execution and to protecting it against unauthorized access. The client has the right to access, rectify, oppose, limit, port and erase their personal data. For more details, consult our Privacy Policy.
16. Applicable law
These Terms of Sale are subject to French law. In case of dispute, after failure of an amicable solution, French courts will have exclusive jurisdiction.
